URGENT ACTION! – Support Indigenous Rights in Chile!
Sara Huincatripay is a member of the Mapuche community Wechun Lleu. Sara is the first Mapuche woman in Arauco Province to be prosecuted and persecuted under Chile’s 2023 Usurpation Law, decreed and supported by President Gabriel Boric’s administration to criminalize Mapuche attempts to reclaim ancestral lands. Her trial began on 30 January 2025.

We the undersigned individuals and organizations, are writing to demand the repeal of the Ley de Usurpación (Usurpation Law), passed in 2023 by your administration, which is in direct contradiction with Chile’s international obligations under both International Labour Organization (ILO) Convention 169 as well as the United Nations Declaration on the Rights of Indigenous Peoples (UNDRIP), which Chile ratified in 2007.
We are also demanding that Sara Huincatripay, the first Mapuche woman in Arauco to be prosecuted under this law, be immediately acquitted and that no other Mapuche or Indigenous Peoples are charged under the Usurpation Law.
As you are aware, ILO Convention 169 is an international treaty that protects the rights of Indigenous peoples, particularly in relation to their lands and resources. It establishes the obligation for states to consult with Indigenous peoples on any measures that may affect them and to respect the territorial rights of peoples who have traditionally occupied and used these lands. The Usurpation Law, by criminalizing land occupations, threatens these very rights, especially for the Mapuche and other Indigenous communities who are fighting to reclaim ancestral lands, stolen over centuries of dispossession.
Furthermore, the UN Declaration on the Rights of Indigenous Peoples (UNDRIP) sets forth fundamental principles that Chile has committed to uphold. UNDRIP explicitly recognizes the right of Indigenous peoples to self-determination and to own, use, develop, and control their lands, territories, and resources as vital to their cultural survival and identity (Article 26). Additionally, the Declaration underscores the requirement for free, prior, and informed consent (FPIC) from Indigenous peoples before any project or measure is undertaken that may affect their lands (Article 32).
The Usurpation Law, by prioritizing private property rights over Indigenous territorial claims and enabling evictions and the criminalization of land occupations, directly contradicts the right to free, prior, and informed consent, as outlined in UNDRIP. This law does not guarantee a meaningful consultation process nor ensure the active participation of Indigenous communities in decisions that affect their lands. It also disregards the legitimate claims of the Mapuche and other Indigenous communities, many of whom are occupying land not out of defiance but as part of their struggle to recover territories that were historically taken from them.
The Mapuche struggle for land is not a matter of criminality—it is a matter of historical justice, dignity, and human rights. Chile’s commitments under UNDRIP and ILO Convention 169 require that your government respect Indigenous territorial rights, foster genuine dialogue, and recognize land rights as a fundamental human right for the Mapuche and other Indigenous peoples.
You must suspend the Usurpation Law and initiate a genuine consultation process with the Mapuche people and other Indigenous communities. This consultation must be carried out in accordance with the principles of free, prior, and informed consent (FPIC), ensuring that the voices of Indigenous communities are central to decisions that affect their lands and cultural survival.
Chile has a responsibility—not only to its citizens but to the international community—to ensure that its laws and policies align with its international commitments under UNDRIP and ILO Convention 169, and to build a society that respects the rights of all its peoples.
You must take the necessary steps to ensure that Chile fulfills its international obligations and upholds the fundamental rights of Indigenous peoples.

Nosotros, las organizaciones abajo firmantes, le escribimos para expresar nuestra grave preocupación por la Ley de Usurpación, aprobada en 2023 por su administración, que está en directa contradicción con las obligaciones internacionales de Chile bajo tanto el Convenio 169 de la Organización Internacional del Trabajo (OIT) como como la Declaración de las Naciones Unidas sobre los Derechos de los Pueblos Indígenas (DNUDPI), que Chile ratificó en 2007.
También exigimos que Sara Huincatripay, la primera mujer Mapuche en Arauco procesada bajo esta ley, sea inmediatamente absuelta y que ningún otro Mapuche o pueblo Indígena sea acusado bajo la Ley de Usurpación.
Como usted sabe, el Convenio 169 de la OIT es un tratado internacional que protege los derechos de los pueblos Indígenas, especialmente en lo que respecta a sus derechos sobre la tierra y los recursos. Establece la obligación de los Estados de consultar a los pueblos Indígenas sobre cualquier medida que pueda afectarlos, y de respetar los derechos territoriales de los pueblos que han habitado y utilizado tierras tradicionalmente. La Ley de Usurpación, al criminalizar las ocupaciones de tierras, pone en peligro estos derechos, especialmente para los pueblos Mapuche y otras comunidades Indígenas que luchan por recuperar tierras ancestrales, arrebatadas a lo largo de siglos de despojo.
Además, la Declaración de las Naciones Unidas sobre los Derechos de los Pueblos Indígenas (DNUDPI) establece principios fundamentales que Chile se ha comprometido a defender. La DNUDPI reconoce explícitamente el derecho de los pueblos Indígenas a la autodeterminación y a poseer, utilizar, desarrollar y controlar sus tierras, territorios y recursos como vitales para su supervivencia e identidad cultural (Artículo 26). Además, la Declaración subraya la necesidad de que los pueblos Indígenas otorguen su consentimiento libre, previo e informado (FPIC) antes de que se realicen proyectos que puedan afectar sus territorios (Artículo 32).
La Ley de Usurpación, al priorizar los derechos de propiedad privada por encima de los derechos territoriales Indígenas y al permitir expulsiones y criminalización de las ocupaciones de tierras, contraviene directamente el derecho al consentimiento previo, libre e informado, tal como lo establece UNDRIP. Esta ley no garantiza un proceso de consulta genuino ni asegura la participación activa de las comunidades Indígenas en las decisiones que afectan sus tierras.
Además, ignora los reclamos legítimos de las comunidades Mapuche y de otros pueblos Indígenas, quienes han sido despojados históricamente de sus territorios y ahora buscan recuperar el control sobre sus tierras para asegurar su supervivencia cultural y económica.
La lucha de los pueblos Indígenas por sus tierras no es un asunto de criminalidad, sino de justicia histórica, dignidad y derechos humanos. Los compromisos de Chile con los principios de la UNDRIP y el Convenio 169 de la OIT exigen que su gobierno respete los derechos territoriales de los pueblos Indígenas, promueva un diálogo genuino y reconozca el derecho a la tierra como un derecho fundamental de los pueblos Mapuche y otras comunidades Indígenas.
Se debe suspender la Ley de Usurpación e iniciar un proceso genuino de consulta con el pueblo Mapuche y otras comunidades Indígenas. Esta consulta debe realizarse de acuerdo con los principios del consentimiento libre, previo e informado (CLPI), asegurando que las voces de las comunidades Indígenas sean centrales en las decisiones que afectan sus tierras y su supervivencia cultural.
Chile tiene la responsabilidad, no solo con sus ciudadanos, sino también con la comunidad internacional, de asegurar que sus leyes y políticas se alineen con los compromisos adquiridos en virtud de UNDRIP y el Convenio 169 de la OIT, para construir una sociedad más justa, equitativa e inclusiva para todos.
Debe tomar las medidas necesarias para garantizar que Chile cumpla con sus obligaciones internacionales y respete los derechos fundamentales de los pueblos Indígenas.
